Confirmation and Acceptance of the Terms of Service
The proprietary and operation rights of the ibibo Free Mail Service (hereinafter “the Service”) belong to ibibo Web Pvt Ltd. (hereinafter “ibibo”). Prior to your voluntary use of the Service, you must read the Terms of Service (“TOS”), available on www.ibibo.com, carefully and accept the TOS (if you are a minor, you shall read the TOS accompanied by your legal guardian; and if you are an entity, you shall make sure that the person installing and using the software must have legal qualifications to bear relevant liabilities). Unless you accept the TOS, you will have no right to use the Service. Your registration for and use of the Service will be deemed that you accept the TOS and agree to abide by the provisions of the TOS.
Description of ibibo Free Mail Service
The ibibo Free Mail Service is brought to you by ibibo using the email service system and based on the TOS specified by ibibo and agreed by you to enable you to send and receive emails through the Internet.
You must:
prepare the devices necessary for surfing on the Internet; and
bear, on your own account, the relevant fees such as telephone and information charges for the Internet service and your use of the Service.
Commencement and Termination of the Service
Upon your acceptance of the TOS specified by ibibo and completion of the corresponding registration process, you will be a valid user of a ibibo free mailbox and need not to pay any fees to ibibo for your use of the Service.
ibibo reserves the right to charge fees for future use of mailbox service, in ibibo's sole discretion. If ibibo decides to charge fees, such charges will be disclosed to You prior.
You agree that ibibo has the right to terminate the Service without any reason at any time.
Amendment and Interpretation of the TOS
ibibo reserves the right to amend and interpret the TOS in the case of necessary. The amended TOS will be posted on relevant website pages upon any amendment. If you do not agree with such amendments, you may cancel the Service. If you continue to use the Service, it shall be regarded as your acceptance of such amendments.
About User Information
ibibo is concerned about protection of users’ privacy. In consideration of the importance and security of the Service, you agree to:
provide true personal information; and
update your registration data promptly if there is any change in your personal information.
If you provide any personal information that is untrue, ibibo has the right to cease to provide you with the Service, and you shall bear the losses and damages thus incurred on your own account. Ibibo will save your registered personal data during the period when your registered identity is maintained. You agree to accept the commodity promotional materials and other related commercial information sent to you by ibibo through emails.
User Account, Password and Security
You shall register your email account in accordance with the regulations of ibibo, laws of the state and public order and good morals. You hereby agree that ibibo may adjust your email account as required.
You shall keep your email account and password safe. At the same time, you shall be fully responsible for all activities performed through the use of your email account. In case you find your account is unlawfully used by other persons or there is any security loophole, you shall immediately notify ibibo of such situation.
Service Risk System
You shall be fully responsible for all risks arising from your use of the Service. Ibibo makes no warranties, whether express or implied, for the Service, and at the same time, makes no restrictions on implied commercial warranties and appropriate warranties for a particular purpose and non-violated ones, including that ibibo makes no warranty that (i) the Service will meet your requirements; (ii) the service will be uninterrupted, timely, secure, or error-free; (iii) the files will not be lost; (iv) the products or shopping services purchased or obtained by you through the mail service network or the transaction progress thereof will be secured; and (v) ibibo will bear some indemnities.
User Managment
You shall bear the legal liabilities for the content you transmitted. You shall comply with all local, state and international laws and all regulations on the Internet applicable to email service. You must:
abide by relevant Indian laws and statutes when transmit data from India to overseas;
not conduct unlawful activities when using the Service;
not interfere with the network service; and
abide by the Internet ethics.
You shall not use the Service to create any chain letters or junk mail or distribute mails to any unauthorized receiver. You shall undertake that you will not transmit any unlawful, harassing, slanderous, abusive, threatening, harmful, obscene and other information. In addition, you shall not transmit any information that may (i) instigate others to commit crimes; (ii) not be allowed by the ethics; (iii) concern state securities; and (iv) not accord with local, state and international laws and ethics. You shall not utilize the Service to access the other person’s computer system without authorization.
If your activities are not in compliance with the provisions of the TOS, ibibo has the right to cancel the provision of the Service for you in accordance with the actual situation.
Proprietary Rights
The proprietary rights of the Service belong to ibibo. Without permission or authorization of ibibo, you shall not perform, including but not limited to, the following activities: to use, reproduce, amend, link to, cite, compile, issue or publish the content of the Service, to build mirror website of the said information, or to develop related derivative products, works or services by using the Service.
Any software or service derived from the Service that is not developed and officially released by ibibo or not authorized by ibibo to be developed and officially released is illegal. Any download, installation or use of such software or service may result in unpredictable risks, and ibibo shall bear no responsibility for any legal liabilities or disputes thus incurred. You shall not download, install or use such software rashly. Otherwise, Ibibo has the right to cease your use of the Service.
The commercial information provided for you by ibibo is under the protection of copyright laws, trade mark laws, label laws and other property laws. Without written authorization of ibibo or the right holder of such information, no one is allowed to reproduce, amend, recompose or use such information.
Safeguard
You agree to safeguard and maintain the interests of all users of the ibibo email accounts and of ibibo. You further undertake to be liable for all results and losses incurred by your own activities.
Termination of the Service
ibibo hereby reminds the User that, in order to reserve the discretionary right of ibibo in its business development and adjustment, ibibo has the right to, with or without prior notification, amend the content of the Service, and discontinue or suspend the Service. Any amendment will be published as an announcement on relevant pages at the website of ibibo. Such announcement shall be deemed as a notification upon being published. In case any loss is incurred by ibibo due to its exercise of the right to amend or discontinue the Service, ibibo shall not bear any liability to any user or third party.
You agree that if there is no login log of your registered ibibo free mail account within a consecutive period of 90 days, ibibo has the right to freeze your account and delete the emails in your mailbox.
If you do not accept the TOS or the TOS that may be amended by ibibo in future, you may select to:
3.1) cease the use of the Service provided by ibibo; or
3.2) notify ibibo of cease of the provision of the Service for you.
When provision of the Service is ceased, your right to use the Service is terminated immediately. ibibo will not transmit any unread or undelivered mail to you or to any third party.
Notifications
All notifications to users may be transmitted through emails, conventional letters or website announcements. Any amendment of the TOS or change in the Service or other important matters may be conducted in the said mode. Such notifications shall be deemed as being delivered to the receiver on the date when such notifications are being sent or announced.
